In the aftermath of the recent Coldplay concert, many of you have observed the various reactions circulating on social media. However, it is important to consider how these events and the related discussions may affect you and your business.
There has been significant attention on social media regarding the behaviour of attendees and the experiences of those present. Work events often highlight the potential for inappropriate conduct, including incidents of harassment, which can have far-reaching consequences for both individuals and organisations.
As of 26 October 2024, the law on worker protection was amended and it has introduced a legal duty for employers to ensure they protect workers from third-party sexual harassment. Under these new provisions, employers are now required to take “all reasonable steps” to prevent sexual harassment in the workplace, meaning that employers will be liable for the actions of third parties, which includes patients, suppliers and anyone else that comes into the practice. If the Employment Tribunal finds that an employer has breached this duty, they will be able to increase compensation by up to 25%.
Taking proactive steps to prevent harassment in the workplace demonstrates an employer’s commitment to maintaining a safe and respectful environment for all. It is important to recognise that even if an employer or members of the team have not personally engaged in inappropriate conduct, the actions of others within the business environment must also be considered.
Ensuring compliance with your legal obligations is not only essential for safeguarding the wellbeing and dignity of staff, but also for protecting your business from potential liability and reputational damage. We would strongly advise that you do take steps to ensure compliance with your statutory duties, including updating any policies and procedures and providing training to all members of staff.
At Buxton Coates Solicitors, we have created a Worker Protection Pack designed to assist you in meeting your statutory duties under the new legislation. Please contact our Employment Team on 0330 088 2275 for more information on how we can assist you.
